Academy sues over unofficial ‘Oscar gift bag’

The Academy Awards has filed a lawsuit against a company promoting an unofficial “Oscar gift bag” that features a sex toy and a vaporizer.

Distinctive Assets has been selling unofficial “Oscar gift bags” for several years. The company advertises its gift bags with slogans such as “Everyone Wins at the Oscars! Nominee Gift Bags” and has even offered bags to real-life Oscar nominees as a publicity stunt.

On Tuesday (February 16) the Academy filed a lawsuit against Distinctive Assets, citing in its legal documentation the “less than wholesome” nature of its 2016 gift bag. According to Variety, the bag’s contents include a $250 sex toy, a $250 marijuana vaporizer, a $5,500 voucher for plastic surgery and a $1,900 voucher for a procedure called a “vampire breast lift”.

In its lawsuit, the Academy contends: “Distinctive Assets’ continued use of the Academy’s trademarks not only infringes the Academy’s trademarks, but it is also likely to dilute the distinctiveness of the Academy’s famous trademarks and tarnish their goodwill.”
